Introduction
A case will follow one of two policies (Appendix E or Appendix F) for adjudication. The policy a case will follow will depend on whether an incident was investigated under the previously existing process (Appendix E) or the new DOE grievance process (Appendix F). The Office for the Prevention of Harassment and Discrimination (OPHD) determines which process will be followed when they receive a report and will inform the parties at that time. The adjudication procedures outlined here occur after the OPHD has completed their formal investigation. Information about timelines, differences between the two hearing processes, and appeal grounds can be found below.
