OPHD received 296 reports of Protected Category discrimination and harassment in the 2022-23 fiscal year. However, the number of distinct allegations was higher, as a given report may include several types of allegations. For example, one complaint could allege that both sex discrimination and racial discrimination occurred simultaneously. All in all, the 296 reports of Protected Category contained 335 distinct allegations. As illustrated in Figure 14, the most frequent type of allegation was about discrimination or harassment based on race (31%), followed by sex/gender discrimination and harassment allegations at 27%. (In Figure 14, the Race category includes allegations of discrimination/harassment based on race, ethnicity, and color. The Sex/Gender category includes allegations of discrimination/harassment based on sex, gender expression, gender identity, sexual orientation, and pregnancy.)
Of the 88 sex/gender discrimination and harassment allegations, 11 allegations involved pregnancy discrimination/harassment, while 5 involved discrimination/harassment based on sexual orientation. 25 of the sex/gender allegations pertained to discrimination/harassment based on gender identity and 1 was based on gender expression. Discrimination and harassment complaints based on gender identity were most often about repeated misgendering of a complainant, or about the use of pronouns that do not match the complainant’s gender identity.
Disability discrimination/harassment allegations (22%) were the second most common types of allegations. Discrimination/harassment based on national origin and citizenship (7%), religion (5.5%), unspecified (4%), followed. Age and medical condition discrimination each represented less than 2% of cases. Figure 14 excludes 7 reports of retaliation related to discrimination and harassment reports.
