Who reported protected category discrimination and harassment to OPHD (2022-23)

Complainants (impacted parties) themselves directly submitted 35.8% (106) of discrimination and harassment allegations reported by OPHD; 41.9% (124) of allegations were reported on behalf of complainants by UC Berkeley employees (Figure 17).

Of 296 total reports, 124 (41.9%) were made by employees, 106 (35.8%) by complainants, 48 (16.2%) by others, and the rest were anonymous/unknown.

These proportions differ from what is seen with SVSH allegations, only 17% of which are reported directly by complainants themselves (Figure 13). This difference may be due to stigma about reporting SVSH; it may also be due to differences in policy. The SVSH Policy, which requires any employee who is not confidential to report to OPHD when they learn of Prohibited Conduct. As of the 2022-23 fiscal year, reporting of other protected category discrimination or harassment was obligatory only for managers and supervisors. The difference could also derive from the fact that employees did not receive as much education about their reporting responsibilities for protected category discrimination and harassment as they do for SVSH. This may change in future years. As of late 2023, a draft UC Anti-Discrimination Policy was released for review and comment. Once the revised policy is finalized, more education and awareness about the reporting obligations under this policy can be expected.
